Welcome to Comanajer. These Terms of Use ("Terms") govern your access to and use of the Comanajer mobile application and related services (collectively, the "Service") provided by Comanajer ("we," "our," or "us").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

1. Acceptance of Terms

By creating an account or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Eligibility

To use the Service, you must:

  • Be at least 13 years of age
  • Have a valid GitHub account
  • Have the legal capacity to enter into a binding agreement
  • Not be prohibited from using the Service under applicable laws

3. Account Registration

3.1 GitHub Authentication

The Service requires authentication through GitHub. By connecting your GitHub account, you authorize us to access certain information from your GitHub account as described in our Privacy Policy.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3.3 Accurate Information

You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

4. Use of the Service

4.1 Permitted Use

You may use the Service to:

  • Generate summaries of engineering activity from your GitHub repositories
  • Receive notifications about your team's progress
  • Access historical summaries and insights
  • Manage your notification preferences

4.2 Prohibited Use

You agree not to:

  • Use the Service for any illegal or unauthorized purpose
  • Attempt to gain unauthorized access to the Service or its systems
  • Interfere with or disrupt the Service or servers
  • Use automated means to access the Service without our permission
  • Reverse engineer, decompile, or disassemble the Service
  • Remove or alter any proprietary notices or labels
  • Use the Service to collect information about other users without consent
  • Impersonate any person or entity
  • Violate any applicable laws or regulations

5. GitHub Repository Access

By selecting repositories for monitoring, you represent and warrant that:

  • You have the necessary permissions to access and share data from those repositories
  • Your use of repository data complies with GitHub's Terms of Service
  • You have obtained any required consent from repository collaborators or organization owners

We access repository data solely to provide the Service and generate summaries as requested by you.

6. Subscription and Payments

6.1 Free Trial

We may offer a free trial period for new users. The trial period and its terms will be communicated to you at the time of registration.

6.2 Paid Subscriptions

Certain features of the Service may require a paid subscription. Subscription fees, billing cycles, and payment terms will be disclosed before purchase. All payments are processed through the App Store (iOS) or Google Play Store (Android).

6.3 Cancellation

You may cancel your subscription at any time through your device's app store settings. Cancellation will take effect at the end of the current billing period.

6.4 Refunds

Refunds are handled according to the policies of the App Store or Google Play Store, as applicable.

7. Intellectual Property

7.1 Our Rights

The Service, including its design, features, content, and underlying technology, is owned by Comanajer and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent.

7.2 Your Content

You retain ownership of your GitHub repository data. By using the Service, you grant us a limited, non-exclusive license to access and process your repository data solely to provide the Service.

7.3 Generated Summaries

Summaries generated by the Service are created using your data and AI technology. You may use these summaries for your personal or internal business purposes.

8. Third-Party Services

The Service integrates with third-party services including GitHub, Firebase, and OpenAI. Your use of these services is subject to their respective terms of service and privacy policies. We are not responsible for the actions or policies of third-party services.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Service will be uninterrupted, error-free, or secure
  • The summaries generated will be completely accurate or comprehensive
  • Defects will be corrected
  • The Service will meet your specific requirements

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, COMANAJER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless Comanajer and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including attorneys' fees) arising out of or related to:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your violation of any applicable laws

12. Termination

12.1 Termination by You

You may terminate your account at any time by contacting us at support@comanajer.com or through the app settings.

12.2 Termination by Us

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Reasons for termination may include, but are not limited to:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Extended period of inactivity
  • Request by law enforcement or government agencies

12.3 Effect of Termination

Upon termination, your right to use the Service will immediately cease. We may delete your account data in accordance with our Privacy Policy.

13. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Comanajer operates, without regard to its conflict of law provisions.

15. Dispute Resolution

Any disputes arising from or related to these Terms or the Service shall be resolved through good faith negotiations. If negotiations fail, disputes shall be submitted to binding arbitration in accordance with applicable arbitration rules.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Comanajer regarding the Service and supersede all prior agreements and understandings.
